BACKGROUND …

Georgia enacts law letting panel punish, oust prosecutors. “Gov. Brian Kemp signed a bill into law Friday creating a new commission empowered to discipline and remove wayward prosecutors, saying it will curb “far-left prosecutors” who are ‘making our communities less safe.’  Kemp made the remarks at the Chatham County Sheriff’s Office in Savannah, where he signed the measure establishing the Prosecuting Attorneys Qualifications Commission, which will launch July 1 and start accepting complaints Oct. 1. ‘I am not going to stand idly by as rogue or incompetent prosecutors refuse to uphold the law,’ Kemp said. ‘Today we are sending a message that we will not forfeit public safety for prosecutors to let criminals off the hook.’” (The Associated Press, 05/07/23)

 

Kemp poised to sign bill that allows ouster of local Georgia prosecutors. “Georgia Gov. Brian Kemp (R) is poised to sign legislation as early as Friday that would create a commission with the power to remove local prosecutors from office, a move Democrats in the state have decried as a power grab that usurps the will of local voters.” (The Washington Post, 05/07/23)

 

Georgia’s GOP governor signs bill that could remove local prosecutors and DAs from their jobs. “Republican Gov. Brian Kemp of Georgia signed legislation Friday that will create an oversight commission with the power to remove local prosecutors and district attorneys from their jobs. … Prior to the signing, Kemp’s office said that the measure, known as SB 92, would create “an oversight mechanism for district attorneys and solicitors-general across Georgia to ensure accountability in upholding constitution and statutory duties.” (CNN, 05/07/23)
